..Respondents (R3 suo motu impleaded vide order dated 10.06.2026 in W.P.No.21341 of 2026 by KRJ) Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for a writ of mandamus, directing the 1st Respondent herein, to consider, decide and dispose of the Arbitration Applications, filed under Section 3-G(5) of the National Highways, Act, 1956, (Act 48 of 1956), by the petitioner, against the Award passed by the 2nd respondent in Na.Ka.No/N.H.45C/ 1085/2012 dated 30.06.2017 in accordance with law.

ORDER

This Writ Petition has been filed to direct the respondents to consider the petitioners' arbitration applications.

2. Learned counsel for the petitioners would submit that the petitioners have made arbitration applications before the first respondent under Section 3G(5) of the National Highways Act, 1956, (act 48 of 1956), against the award passed by the second respondent in Na.Ka.No/N.H.45C/1085/2012 dated 30.06.2017. However, the said arbitration applications was not considered, as on date. Hence, this writ petition.

3. Mr.M.Guruprasad, learned Government's Counsel accepts notice on behalf of the respondents 1 & 2. Mrs.S.R.Sumathy, learned Standing Counsel takes notice on behalf of suo-motu impleaded third respondent and submitted that the petitioners' arbitration applications will be considered within a period of twelve weeks.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the limited relief sought by the learned counsel for the petitioners, this Court without expressing any opinion on the merits of the case, directs the first respondent to dispose of the petitioners' arbitration applications, after issuing due notice to the petitioner and other aggrieved persons, if any, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition stands disposed of. No costs.
