This writ petition has been filed for a direction to the 2nd respondent to cancel the patta standing in the name of 4th respondent in Patta No.229 for the property in Survey Nos.75/5A, 75/5D and issue a patta in the name of the petitioner and further transfer the patta name in Patta No.230 in petitioner's name by considering petitioner's representation dated 02.08.2023.
2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.
3. Petitioner purchased the property of an extent of 29 cents in S. No.75/5 at Sirunamalli Village, Nemili Taluk, Ranipet District through a Page 2/5
registered sale deed in Document No.38 of 1985 dated 25.01.1985. The said Govindan had purchased the property from one Mani vide Document No.465 of 1984. Now the property has been sub divided into Survey Nos.75/A, 75/5C and 75/5D. One Muniyan belongs to same village, created obstacles to the petitioner stating that his mother, namely the 4th respondent is the owner of hte property and patta No.229 stands in her name. Similarly, the land in S.No.75/5C relating to Patta No.230 is still in the name of previous owner. Hence she gave a representation to the respondents to rectify the patta and for name transfer. No action was forthcoming, she has filed this writ petition.
4. Considering the limited relief sought in this writ petition, the second respondent is directed to consider the representation of the petitioner dated 02.08.2023 for mutation of patta, on merits and in accordance with law, after giving notice to 4th respondent or any other interested persons. Such exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
