This writ petition is filed under Article 226 of the Constitution of India seeking writ of mandamus directing the respondents herein to revoke the order of approval, passed by the 4th respondent, dated 04.11.2004, in so far as it pertains to granting of approval of appointment of the petitioner with effect from 01.06.2003 and thereby grant approval of appointment to the petitioner as a Middle Grade Graduate Teacher / B.T. Assistant in the 5th respondent school, with effect form the date of joining i.e., 31.03.2003, with all consequential

benefits, including the benefit of old Pension scheme in the light of the order passed in W.P. No.40722 of 2015, dated 28.03.2023 confirmed in W.A.Nos.1093 of 2023 and 6530 of 2024 by a common order dated 29.02.2024. For Petitioner(s):

Mr. V.Sivalingam Government Advocate R1 to R4 Order This writ petition is filed for the following relief: "To direct the respondents herein to revoke the order of approval, passed by the 4th respondent, dated 04.11.2004, in so far as it pertains to granting of approval of appointment of the petitioner with effect from 01.06.2003 and thereby grant approval of appointment to the petitioner as a Middle Grade Graduate Teacher / B.T. Assistant in the 5th respondent school, with effect form the date of joining i.e., 31.03.2003, with all consequential benefits, including the benefit of old Pension scheme in the light of the order passed in W.P. No.40722 of 2015, dated 28.03.2023 confirmed in W.A.Nos.1093 of 2023 and 6530 of 2024 by a common order dated 29.02.2024."

2. The petitioner was appointed as a Junior Grade B.T.Assistant in the 5th respondent school. The petitioner joined the service on 31.03.2003. Thereafter, the 5th respondent school sought approval of the petitioner's appointment and the same has been granted, however, with effect from 01.06.2003. Therefore, the petitioner made representation dated 05.03.2025 requesting for approval of her appointment with effect from 31.03.2003. The 5th respondent school has also sent a proposal in this regard. However, the same has not been granted, constraining the petitioner to approach this Court.

3. It is submitted that in a similar case in WP.No.40722 of 2015, this Court allowed the writ petition filed by the similarly placed person. The appeal filed before the Division Bench of this Court and the SLP filed before the Hon'ble Supreme Court by the State have been dismissed.

4. Heard the learned counsels on the either side and perused the records.

Considering the facts and circumstances of the case and in view of the above submission, a direction is issued to the respondents 1 to 3 to consider the petitioner's representation and pass orders in the light of the order passed in WP.No.40722 of 2015, within a period of 2 months from the date of receipt of a copy of this order.
