ORDER

This application has been filed to condone the delay of 203 days in representing the case papers in C.M.P.SR.No.139890 of 2023.

2. In the affidavit filed in support of the petition it had been contended that the papers have been mixed up with other papers in the C.V. KARTHIKEYAN,J., 1/2 https://www.mhc.tn.gov.in/judis

CMP No.19661 of 2024 vum office of the counsel. It is also contended that the appellants are senior citizens of advanced age and could not personally come over to give necessary instructions.

3. The counsel for the respondents is also present and raised objections over restoring the Second Appeal.

4. The learned counsel would be given an opportunity when the application either to condone the delay in filing the application to restore the appeal or to restore the appeal for consideration is filed before this Court.

5. However, taking all these factor into consideration, this application is allowed.
