This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 07.06.2024, seeking bail in Crime No.232 of 2024 registered for the offence under Sections 341, 294(b), 397 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case since he has several previous cases. He further submitted that the petitioner, who is no way connected with the alleged offence, has been suffering incarceration from 07.06.2024. Hence, he prayed to grant bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that, the petitioner had waylaid the de facto complainant, abused him in filthy language, robbed a sum of Rs.200/- and a keypad mobile phone from him at knife point. He further submitted that the case is under investigation and the petitioner is a habitual offender, having 20 previous cases. Therefore, if he is released on bail, there is every possibility of him absconding and threaten the witnesses.

Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the fact that the investigation is not yet completed and also considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
