Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd respondent to consider the petitioners representation dated 02.05.2026 and not to interfere with the administration, management and customary religious practices of Arulmigu Malaiamman Temple situated at Navakurichi Village, Thalaivasal Taluk, Salem District, pending disposal of O.A.No.19 of 2023 under section 63(b) of the Tamilnadu Hindu Religious and charitable endowments act and O.S.No.128 of 2026 on the file of sub court, attur.

ORDER

This writ petition has been filed to direct the respondents to consider the petitioner's representation dated 02.05.2026.

2. Mr.M.Veerabathran, learned Government's counsel, takes notice on behalf of the respondents.

3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself.

4. The learned counsel for the petitioner would submit that in this case, the petitioner had filed an application in OA.No.19 of 2023 for appointment of Trustee. However, the said application was not at all considered by the respondents till date. Hence, this petition.

5. In reply, the learned Government's counsel appearing for the respondent would submit that in this case, the application filed by the petitioner was already disposed of as early as on 19.09.2025.

6. On the other hand, the learned counsel for the petitioner would submit that no copy of the order dated 19.09.2025 was served on the petitioner.

7. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.

8. In the case on hand, according to the petitioner, the petitioner had filed an application in OA.No.19 of 2023 for appointment of Trustee. However, the said application was not at all considered by the respondents till date.

9. On the other hand, it was submitted by the respondents that the application filed by the petitioner was already disposed of as early as on 19.09.2025.

10. In view of the above, the respondents is directed to serve a copy of the order dated 19.09.2025 to the petitioner within a period of 2 weeks from the date of receipt of a copy of this order. Upon receipt of the said order, it is up to the petitioner to challenge the same in the manner known to law.
