The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 294(b) and 420 of IPC, in Crime No. 189 of 2023 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution as per the defacto complainant is that the petitioner, in order to secure jobs at Maldives, has approached the defacto complainant and received a sum of Rs.23,00,000/- lakhs from him. Thereafter, the petitioner neither secure any job nor return the money and when the defacto complainant questioned the same, the petitioner abused him in filthy language and refused to return the money and thereby cheated the defacto complainant. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this
case. He would further submit that the defacto complainant wantonly approached the petitioner and induced him to invest more money in this business and the defacto complainant also received more than 19 lakhs from various customers. He would also submit that the petitioner is ready to abide by any condition imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.
4. Per contra, the learned Government Advocate (Crl. Side) would submit that the defacto complainant is running a firm in the name of M/s.Inframec Fly Overseas. While so, the petitioner has induced the defacto complainant to invest money in the business of securing jobs at Maldives and received a sum of Rs.23,00,000/- and the accused has not secured any jobs and thereby cheated him. He would further submit that the matter is under investigation and custodial interrogation of the accused is required in this case. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondent and perused the materials.
6. Considering the nature and gravity of offence committed by the petitioner and taking into consideration the case is under investigation, this Court is not inclined to grant anticipatory bail to the petitioner for the present. Accordingly, this Criminal Original Petition is dismissed.
