ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.03.2026 for the alleged offences under Sections 10, 11(1) read with 12 of POCSO Act, 1985 and Section 87 of B.N.S. in Cr. No.7 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner has committed sexual assault on the victim girl, aged about 8 years old and hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has nothing to do with the commission of offences as alleged by the prosecution. The learned counsel would further submit that according to the prosecution, the occurrence took place a week back and the FIR has been registered belatedly and the petitioner has been remanded to judicial custody on 08.03.2026 and hence prayed to enlarge the petitioner on bail.

4. The learned Government Advocate (Criminal side) appearing for the respondent police would submit that the allegations are serious in nature and therefore, he strongly objected the bail application.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

From the submissions made by the learned Government Advocate, it is seen that the FIR came to be registered on 07.03.2026, however, the petitioner has been remanded to judicial custody on 08.03.2026. It is the submission of the learned counsel for the petitioner that according to the prosecution, the

occurrence took place a week back, however, the FIR has been registered belatedly. The learned Government Advocate submits that the allegations are serious in nature not only against this victim, but there are other victims also. Considering the seriousness of the allegations, this Court is of the firm view that it is not an appropriate stage to consider the bail application and therefore, this Court is not inclined to enlarge the petitioner on bail.

7. Accordingly, this Criminal Original Petition is dismissed. 05-06-2026 MJS Note:
