( Criminal Jurisdiction ) Thursday, the Seventh day of October Two Thousand Twenty One PRESENT The Hon`ble Mr Justice M.DHANDAPANI CRIMINAL MISCELLANEOUS PETITION No.10009 of 2021 IN CRL OP.16039 of 2021 1 JOTHI [ PETITIONERS / ACCUSED ] 2 DHANAPAL Vs STATE REP BY [ RESPONDENT ] THE STATION HOUSE OFFICER, KADAMPULIYUR POLICE STATION, CUDDALORE DISTRICT (CRIME NO.521 OF 2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition in Para 6 (a) i.e., the petitioners should return the 20 teak wood trees to the petitioners father and receive due acknowledgment from him and produce the same before the concerned magistrate at the time of release of bail imposed in Crl.O.P.No.16039 of 2021 dated 14.09.2021 and pass such other order or orders as this Hon'ble Court.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.K.GANDHI KUMAR, Advocate for the Petitioners and of MR.A.GOPINATH, Govt. Advocate (Crl. Side) on behalf of the Respondents the court made the following order:- This Criminal miscellaneous petitions has been filed by the petitioner to modify the condition imposed in para No.6(a) in Crl.O.P.No.16039 of 2021 dated 14.09.2021.
2. This Court granted anticipatory bail to the petitioner based on the submission made by the petitioner that he will return the 20 teak wood trees to the petitioner's father and receive due
acknowledgement from him and produce the same before the concerned magistrate at the time of release of bail. While so the petitioner now submits that he is not ready and willing to comply with the said condition and seeks modification of the said condition and had filed this petition.
3. The learned Government Advocate would submit that the petitioner has not complied with the conditions imposed by this Court.
4. In view of the above, this miscellaneous petition is dismissed. However this Order will not stand on the way to the petitioner to comply with the conditions imposed by this Court and further time is extended by a further period of two weeks from the date of receipt of a copy of this order for the petitioner to comply with the conditions imposed by this Court in Crl.O.P.No.16039 of 2021 dated 14.09.2021.
