The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 457 & 380 IPC, in Crime No.432 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. Learned counsel for the petitioner submitted that petitioner is innocent and he has been falsely implicated in Crime No.432 of 2023, for the alleged offence under Sections 457 & 380 IPC. Thus, he seeks for grant of anticipatory bail for the petitioner. 3.In response, the learned Government Advocate (Crl.side) submitted that defacto complainant is the general manager of M/s.Star Eitech manufacturing India Pvt Ltd. He gave a complaint that, on 19.05.2023, at about 11 p.m., after the completion of work, they locked their company asusual. On the next day, i.e., on 20.05.2023, at about 8.30 a.m., when they opened the shutter, they found copper weighing 400 kgs was stolen by the accused in this case. Therefore, on the basis of the

complaint given by the defacto complainant, FIR in Crime No.432 of 2023 was registered. He further submitted that third accused in this case was arrested and 140 Kgs of copper was recovered. Remaining copper was not recovered for the reason that the other accused are absconding. 4.Considering the fact that the bulk of stolen copper is not recovered so far, for the reason that the accused are absconding, this Court is not inclined to grant anticipatory bail to the petitioner. 5.Accordingly, this Criminal Original petition is dismissed. 26.07.2023 sli
