This application is filed by the applicant seeking to condone the delay of 106 days in filing the application for leave to defend by the third defendant in A.D.No.58328 of 2023 in C.S.(Comm.Div).No.251 of 2022.

2.Heard the learned counsel for the applicant/3rd defendant and the learned counsel for the 1st respondent.

The learned counsel for the 1st respondent would submit that he has no objection for this application being allowed.

3.Being satisfied with the reasons stated in the affidavit filed in support of this application, the application stands condoned and the application is allowed. The Registry is directed to permit the applicant to file application for leave to defend and post the suit on 14.08.2023.
