O R D E R

This Writ Petition (Criminal) has been filed by the petitioner to direct the the 4th respondent to implement the order passed by the 2nd respondent vide Na.Ka.No.511/2023/A1 dated 24.01.2024 and thereby obtain the Original Sale Deed vide Doc.No.698/1993 dated 31.05.1993 on the file of SRO, Annur, Coimbatore District from the 5th respondent and hand over the same to the petitioner within the time limit to be stipulated by this Court.

2. The case of the petitioner is that the petitioner is a senior citizen and owned a property measuring to an extent of 2.06 Acres of land

comprised in Survey No.26/1, situated at Vadakkalur Village, Annur Sub-Registration District, Coimbatore District through Sale Deed No.698/1993 dated 31.05.1993 on the file of SRO, Annur, Coimabtore District. His two sons including the 5th respondent, without maintaining the petitioner and his wife, demanded his self-acquired property. When the same was refused, the 5th respondent forcefully took the original document of the said property. Hence, the petitioner made a petition under Parents and Senior Citizen, Maintenance and Welfare Act based on which, the 2nd respondent passed an order dated 24.01.

2024 directing the 5th respondent to hand over the said original Sale Deed document to the petitioner and also directed the 4th respondent to execute the said order by obtaining the said original sale deed from the 5th respondent and to handover the same to the petitioner. On 09.04.2025, the petitioner sent a representation to the 3rd and 4th respondents to implement the order of the 2nd respondent. But till date, the 4th respondent neither implemented the order nor took steps to implement the same. Hence, the present petition is filed.

3. Heard and perused the materials available on record.

4. Considering the facts and circumstances of the case, the 4th respondent is directed to implement the order passed by the 2nd respondent dated 24.01.2024.

5. With the above directions, this Writ Petition (Criminal) is disposed of.
