Respondent Petition filed under Section 11 (4) (a) of the Arbitration and Conciliation Act, 1996, to appoint a Sole Arbitrator or alternatively appoint an Arbitrator on behalf of the respondent, in terms of the Shareholders Agreement dated 22.12.2011, for the purpose of adjudicating upon the dispute that has arisen between the Petitioner and the Respondent under the Shareholders Agreement dated 22.12.2011.

O R D E R
Learned counsel for the parties state that despite the pleadings before the Court, they have received https://hcservices.ecourts.gov.in/hcservices/
instructions that Mr.Justice S.Rajeswaran (Retd.) may be appointed as the Sole Arbitrator to enter upon reference and adjudicate the disputes inter se the parties and that the arbitration proceedings may take place under the aegis of the Madras High Court Arbitration Centre.
2.In view thereof, I appoint Mr.Justice S.Rajeswaran, a retired Judge of this Court, as the Sole Arbitrator to enter upon the reference and adjudicate the disputes inter se the parties.
As requested, the arbitration proceedings will be conducted under the aegis of the Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Centre.
3.The original petition is, accordingly, allowed, leaving the parties to bear their own costs.
