PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent herein to dispose the Appeal filed by the petitioner herein dated 01.02.2023 within a time frame fixed by this Hon'ble court after hearing the petitioner as well as the 5th and 6th respondents herein and consequently direct the 1st respondent to cancel the sale deed executed by the 5th respondent dated 31.03.1997.

O R D E R

This Writ Petition has been filed to issue a Writ of Mandamus, to direct the first respondent herein to dispose the Appeal filed by the petitioner herein dated 01.02.2023 after hearing the petitioner as well as the 5th and 6th respondents herein and consequently to direct the first respondent to cancel the sale deed executed by the fifth respondent dated 31.03.1997.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the official respondents.

3. Since there is no adverse order passed against the private respondents/R5 and R6 in this writ petition, notice to the private respondents is dispensed with.

4. Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for by the petitioner, without expressing any opinion with regard to the merits of the case, this Court directs the first respondent to dispose the petitioner's appeal dated 01.02.2023 on merits and in accordance with law, after giving notice and opportunity of hearing to the petitioner and respondents 5 and 6 herein and conduct enquiry in the manner known to law within a period of two months from the date of receipt of a copy of this order.

5. With the abovesaid direction, the Writ Petition is disposed of.

There shall be no order as to costs.
