Respondent Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondent to restore the possession of the property to an extent of 5467 sq.ft. in S.No.110, ReSurvey No.110/1, Kannakuruchi Mitta, Kondappanaickenpattu Village, Salem District and to an extent of 338540 sq.ft. in S.No.138/2, Re-Survey No.138/2A, Kannakurichi Mitta, Now Kondappanaickenpattu Village, Salem District to the petitioner and consequently restrain the respondent not to proceed further with the petitioner property to an extent of 5467 sq.ft. in S.No.110, Re-Survey No.110/1, Kannakuruchi Mitta, Kondappanaickenpattu Village, Salem District and to an extent of 338540 sq.ft. in Re-Survey No.138/2, Kannakuruchi Mitta, Now Kondappanaickenpattu Village, Salem District pending disposal of the appeal in MA.Diary No.819 of 2025 before the Hon'ble DRAT, Chennai, by considering the petitioner representation dated 29.05.2025.

ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Counsel seeks leave to withdraw the petition and states that he shall pursue the Miscellaneous Application filed before the Debt Recovery Appellate Tribunal.
Petition is dismissed as withdrawn, with the liberty as prayed for. There shall be no order as to costs. Consequently, the interim application also stands dismissed.
