O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing first respondent to dispose of the appeal filed by petitioner on 22.02.2025 and consequently conduct enquiry against the respondents 2 & 3.

2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed, notice to fourth respondent is dispensed with.

3. Learned counsel for the Petitioner would submit that an appeal dated 22.02.2025 was filed challenging the order of the 2nd respondent dated 29.11.2024 cancelling the grant of patta to the petitioner in respect of the

property comprised in Survey Nos.45/2E and 45/1E, measuring an extent of 1.9 hectares, situated at Periyagaram Village, Thirupattur District. Since the same was not considered, the present writ petition has been filed.

4. Learned Special Government Pleader appearing for respondents 1 to 3 would submit that first respondent would conduct an enquiry after affording opportunity to the petitioner, fourth respondent and any other interested parties and the appeal would be disposed of and orders will be passed within the time frame to be fixed by this Court

5. Taking into consideration the facts and circumstances of the case and the submissions made on either side, there shall be a direction to first respondent to consider the appeal made by the petitioner on 22.02.2025, issuing notice to the petitioner, fourth respondent and rival claimants, if any and affording an opportunity of hearing to the petitioner, fourth respondent and any other interested parties. 1st respondent shall pass orders in the appeal stated to be filed by the petitioner on its own merits and

in accordance with law within a period of sixteen (16) weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to first respondent to consider the case on its own merits and in accordance with law.
