A. No.3263 of 2024 in C.S. No.684 of 2017 ABDUL QUDDHOSE.J., This Court is satisfied with the reasons stated in the affidavit filed in support of A. No.3263 of 2024 which has been filed by the plaintiff seeking to set aside the order dated 22.04.2024 under which the suit as against the first respondent / first defendant came to be dismissed for non prosecution.

2. The learned counsel for the respondents / defendants have also not raised any serious objection for allowing this application. Accordingly, this application is allowed as prayed for and the suit as against the first defendant is restored to file.
