The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the 2nd Respondent to consider petitioners candidature for the post of Assistant in the three unfilled vacancies under the differently abled category in the Notification No.01/2023, dated 10.11.2023 within the period that may be stipulated by this Court.

2. The learned counsel for the petitioner would submit that in pursuance of the above notification, he has participated in the written examination, however, he was not selected. It is the submission of the petitioner that there are 3 unfilled vacancies under the Differently Abled Category are available. If the 2nd respondent had properly appreciated the candidatures of this petitioner, he would have find a place in the selection list. It is the submission of the petitioner that he is having 80% permanent locomotor disability and eligible to be considered for the post of Assistant under the differently abled category.

3. Per contra, the learned Additional Government Pleader appearing for the respondents would strongly object the contention of the petitioner and would submit that as per the roster, selection was made in which the 2/5

petitioner cannot have any grievance. However, if the petitioner is giving any representation, the same would be considered by the 2nd respondent in accordance with their rule position.

In such view of the fair submission, without going into the merits of the writ petition, this Court deems it appropriate to direct the petitioner to submit a representation before the 2nd respondent, within a period of two weeks from the date of receipt of copy of this order. On such receipt of the representation, the 2nd respondent is directed to consider the same and pass orders on it's own merits and in accordance with law, within a period of six weeks thereafter.

5. With the above directions, the Writ Petition is disposed of. No costs. 17.06.2025 Index : Yes/No Speaking order /Non Speaking Order dm 3/5
