ORDER
This writ petition has been filed to issue a Writ of Mandamus, directing the 1 st respondent to renew the petitioners' passport pursuant to the application submitted by the petitioner on 20.05.2025.
2. Heard Mr.C.Prabakaran, the learned counsel for the petitioner, Mr.MP.Jaisha, the learned Central Government Standing Counsel appearing on behalf of the 1 st respondent and Mr.Leonard Arul Joseph Selvan, the learned Government Advocate (Criminal Side) appearing on behalf of the 2 nd respondent.
3. The Passport of the petitioner was not been renewed by the 1 st respondent on the ground that an First Information Report (F.I.R) was registered in Crime No.158 of 2023 by the 2 nd respondent and the same is pending. The
petitioner has been added as one of the accused persons.
4. The learned Government Advocate (Criminal Side) appearing on behalf of the 2 nd respondent submitted that the investigation has been completed and the Police report has been filed before the concerned jurisdictional Court, which is yet to be taken on file.
5. In the considered view of this Court, the 1 st respondent can refuse to grant or renew the passport only if the criminal case is pending.
6. In the case in hand, there is no criminal case pending, as the case till date is at the stage of registration of F.I.R and the police report is yet to be acted upon by the concerned Court.
7. In view of the above, there shall be a direction to the 1 st respondent to deal with the application submitted by the petitioner and renew the passport, if the petitioner has satisfied all the other requirements and the registration of the
FIR should not be put against the petitioner. This process shall be completed by the 1 st respondent within a period of four (4) from the date of receipt of a copy of this order.
8. This writ petition is disposed of with the above directions.
