Defendants PRAYER: Plaint filed under Order VII Rule 1 of the CPC., 1908 r/w. Order IV Rule 1 of the High Court Original Side Rules praying for the judgment and decree against the defendants as follows: (i)Grant Preliminary decree declaring each of the plaintiffs are entitled to 1/7th share in the Schedule mentioned property; 1/3

(ii)Direct the appointment of an Advocate Commissioner to divide the property by metes and bounds and allot one such property to each of the plaintiffs by passing a Final Decree. For Plaintiffs :

J U D G M E N T

On the earlier occasion, it was stated by the learned counsel for the plaintiffs that the matter has been settled and sought time for reporting the same before this Court by way of a memorandum. When the matter came up for hearing today, the learned counsel for the plaintiffs submitted that despite communication given to the plaintiffs, he has not received any instructions from them.

2. Recording the submission of the learned counsel for the plaintiffs, the Civil Suit is dismissed for default. No costs. 27.11.2023 DP 2/3
