The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 6 and 20(1) of COTPA Act 2003 r/w Section 328 of I.P.C, in Crime No.136 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused transported 1 1⁄2 tons of banned Tobacco products illegally in the Eicher vehicle bearing Registration No.TN-25-BL-1847. Hence, the complaint.

3. It is seen from the records that this is the second anticipatory bail petition filed by the petitioner. The earlier petition filed by the petitioner in Crl.O.P.No.16344 of 2022 was dismissed on 14.07.2022. He would further submit that the petitioner has been falsely implicated in this case and he is ready and willing to abide by any stringent condition that may be imposed on him. https://www.mhc.tn.gov.in/judis

4. The learned Additional Public Prosecutor would submit that there are totally 2 accused in which the petitioner is arrayed as A1. The petitioner and other accused were found in possession of banned Tobacco products worth about Rs.8,00,000/-. He would also submit that there is no change of circumstances after the previous order was passed on merits. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the bad antecedents of the petitioner, this Court had dismissed the earlier petition filed by the petitioner and that there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
