This Criminal Miscellaneous Petition is filed by the petitioner seeking for modification of the conditions imposed upon the petitioner by this Court in para No.8 in Crl.O.P.No.12023 of 2025 dated 25.04.2025.
2. The contention of the petitioner is that the petitioner does not have any passport in her name, hence the petitioner was unable to surrender her passport before the learned Magistrate Thiruppur-1 as per the order of this Court. The petitioner, also has filed an additional affidavit stating the above facts, but the same was not entertained by the learned Judicial Magistrate and hence the petitioner though had obtained an order of bail on 25.04.2025, but could not execute the sureties and come out on bail. Now, the petitioner is before this Court with this modification petition.
3. The learned counsel for the petitioner would further submit that the petitioner hails from Palakad and seeks for modification of the condition imposed upon the petitioner by this Court, in para No.9(b) in Crl.O.P.No.12023 of 2025 dated 25.04.2025.
4. Having satisfied with the reasons stated in the affidavit filed in Page No.2 of 6
support of this petition, the condition imposed in para No.8 is modified and the learned Judicial Magistrate No.1, Tiruppur, is hereby directed to accept the additional affidavit filed by the petitioner and without insisting upon production of passport and allow the petitioner to execute the sureties as per the order of this Court in Crl.O.P.No.12023 of 2025 dated 25.04.2025 and further para No.9(b) is modified to the effect that " the petitioner shall report before the respondent police on alternative days at 12.00 noon, for a period of two weeks and thereafter, as and when required for interrogation.
5. Accordingly, this Criminal Miscellaneous Petition is ordered. 20.06.2025 gbi Note :
