..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, call for the records relating to the Eviction Notice dated 05.05.2026 and Eviction Notice dated 15.05.2026 issued by the 6th respondent, quash the same and consequently forbearing the respondents 3 and 6 herein from in any manner evicting or dispossessing the petitioners from the land measuring an extent of 1 cents to 1.5 cents each comprised in T.S.No.5, Block No.3, Alandur Village, Guindy Taluk, situated at Nagireddy Garden Extension, Muneeswaran Nagar, Ekkattuthangal, Chennai - 600032.

ORDER
(Order of the Court was made by Dr.G.Jayachandran J.) The writ petitioners herein claim that they are in occupation of the Grama Natham in Survey No.5 of the subject village. The Government has handed over Survey No.4 to the 6th respondent for the "Labour Nagar Scheme" project. The petitioners are challenging the impugned notice issued to evict them from Survey No.4, which they utilize as a pathway.

The learned Government Advocate appearing for the State submitted that an earlier round of litigation for the identical relief has already been disposed of. He further submitted that the present writ petition has been filed to stall the "Labour Nagar Scheme" project, which is proposed for the welfare of economically weaker sections.

On perusal of the affidavit and the material on record, we find that the claim of the petitioners is based on the usage of Survey No.4 as a pathway to access their property in Survey No.5. However, as submitted by the learned Government Advocate, Survey No.4 is not a recognized access route for Survey No.5, and an alternate access route has already been recognized by the local body.

Therefore, this writ petition, filed to stall a welfare project by claiming right of way through Survey No.4, is unsustainable. Hence, this Writ Petition stands dismissed. Consequently, the connected Miscellaneous Petitions are closed. No costs.
