This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 17.06.2024, seeking bail in Crime No.70 of 2024 registered for the offence under Sections 341, 294(b), 323, 397, 336, 427 & 506(ii) of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner, who is no way connected with the alleged offence, has been suffering incarceration from 17.06.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he sought for bail.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail stating that, when the de facto complainant had questioned the accused for not paying amount for the tea, the petitioner/accused abused him, attacked with hands and robbed a sum of Rs.500/- from him at knife point. He further submitted that the case is under investigation and several cases including the cases registered under Sections 302 & 307 IPC are pending against petitioner. Therefore, if he is released on bail, there is every possibility of him absconding and threaten the witnesses.

Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the fact that the investigation is not yet completed and also considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
