Defendants Plaint filed under Order IV of O.S Rules read with Rule 1 of The Code of Civil Procedure, praying for Judgment and decree against the defendants; [a] declaring that the purported the Extraordinary General Meeting of the 1st defendant Company held on 18.01.2006 is illegal, in violation of law and applicable procedures, vitiated by the presence of and intimidation by non-

shareholders including rowdy elements and private security personal wielding weapons and vitiated by denial of rights to large section of shareholders to participate and vote at the meeting and according the proceedings of the Meeting including any Resolution of the Meeting are unenforceable and not binding on the 1st defendant Company;

[b] granting a consequential permanent injunction restraining the 1st defendant Company and its Directors and Officers from enforcing, implementing or giving effect to any of the resolutions purportedly passed at the Extraordinary General Meeting of the 1st defendant Company held on 18.01.2006; and [c] granting the plaintiff the cost of the suit. J U D G M E N T

Learned counsel for the plaintiffs seek permission of this Court to withdraw this suit, as the matter is settled out of Court between the parties and he has also made an endorsement to that effect on the plaint.

2. In view of the endorsement made by the learned counsel for the plaintiffs, this Suit is dismissed as withdrawn. Since the plaintiffs are not claiming the court fee, the court fee is ordered to be forfeited. No costs. 17.03.2017 bsm/gya
