Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus to direct the respondents 1 to 3 to conduct enquiry for allotment made in favour of the respondents 5 to 18 for allotment of fund for construction of Solar Powered Green Houses under the Chief Minister's Solar Powered Green House Scheme consequently to revise the allotment order and allot Solar Powered Green Houses under the Chief Minister's Solar Powered Green House Scheme to the petitioners.

ORDER

The prayer in the writ petition is for writ of Mandamus to direct the respondents 1 to 3 to conduct an enquiry for allotment made in favour of the respondents 5 to 18 for allotment of fund for construction of Solar Powered Green Houses under the Chief Minister's Solar Powered Green House Scheme consequently to revise the allotment order and allot Solar Powered Green Houses under the Chief Minister's Solar Powered Green House Scheme to the petitioners.

2. The petitioners grievance is that there has been certain remarks in the allotment of funds for construction of Solar Powered Green House Scheme. Venting out their grievance they have given a representation on 25.02.2013 to the respondents. Since their representation has not been considered they had filed the present writ petition.

3. Heard both sides.

4.Though the petitioners had sought for a larger relief for a direction to the respondents to conduct an enquiry, it would be appropriate to pass an order, directing the first respondent to consider the representation made by the petitioners, since non-consideration of their representation amounts to dereliction of their ordinary duties of their office.

5. Under such circumstances and without expressing any of my views made in the representation, there shall be a direction to the first respondent to consider the petitioners representation dated 25.02.2013 and pass orders on its own merits and in accordance with law within eight weeks from the date of receipt of a copy of this order.
