The petitioner seeks an order of injunction to protect his possession of a portion of the property.

2.Mr.Kuberan, learned counsel appearing for the petitioner would submit that the petitioner is a physically challenged person and though there was an order of injunction for some time during the pendency of the suit, it was not extended. However, according to the learned counsel, the respondent have not disturbed the possession of the petitioner. 3.Mr.R.S.Varadarajan, learned counsel for the respondent would submit that the consistent defence of the respondent is that the petitioner is in permissive occupation in the portion of the property and his suit for partition has been dismissed.
