A.No.3394 of 2021 in C.S.No.574 of 2010 is filed to implead the proposed respondent nos.35 to 63 as defendants in the present suit. 2.It is submitted by the learned counsel for the applicant that the proposed respondents/defendants are the sub tenants who are inducted in the suit property subsequent to the filing of the suit. Therefore, their presence is necessary in the suit for effective adjudication of the dispute. Mr.K.V.Bashyamchari, learned counsel for the first defendant has no objection for allowing this application. Despite giving opportunity for filing counter of the respondents, none of them have filed counter. 3.In the circumstances stated in the affidavit and on hearing the submissions of the learned counsel for the applicant and also the first respondent, this Court is of the considered view that the proposed respondents/defendants have to be necessarily impleaded as defendants in the suit.

sli 4.In this view of the matter, this application is allowed. The applicant/plaintiff is directed to file the appropriate application for amending the plaint.
