Respondent Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the respondent to receive the balance outstanding amount by virtue of the resolved order passed in Case No.1238 of 2023 through Lok Adalath organized by District Legal Services Authority, Coimbatore vide settlement memo dated 14.10.2023 and consequently not to take any coercive steps till the disposal of the O.A.No.878 of 2021 on the file of the learned DRT, Coimbatore, within stipulated time fixed by this Court. ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This petition filed under Article 226 of the Constitution of India seeks writ of mandamus directing the respondent bank to receive the balance outstanding amount as per the order passed by the Lok Adalat and not to take any coercive action till the disposal of the O.A.No.878 of 2021.

2. Learned counsel for the respondent/bank submitted that after the order was passed by the Lok Adalat, since the petitioner defaulted in payment of the agreed amount, the bank has initiated proceedings under Section 14 of the SARFAESI Act and thereafter, possession has also been taken. Thereafter, the petitioner trespassed into the property, for which criminal complaints are also pending.

3. Under such circumstances, we refrain from invoking the writ jurisdiction under Article 226 of the Constitution of India for issuing such a direction.

This writ petition is, accordingly, dismissed. There shall be no order as to costs.
