This is the Second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 23.03.2022 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(A) & 22 (c) of NDPS Act, in crime No.62 of 2022 on the file of the respondent police.
2. According to the case of the prosecution, the respondent Police seized 150 fort nite tablets (consisting of 41 Orange colour tablets, 100 blue colour tablets, 7 coffee colour tablets and 2 ash colour tablets), 600 gms of Ganja, 1 gram of Methaphetamine and 80 LSD Stamps weighing 1.25 gms each from the possession of the petitioner. It is a commercial quantity.
3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.16389 of 2022, on 15.07.2022, considering the fact that the petitioner has failed to fulfill the twin conditions as contemplated under Section 37 of NDPS Act, 1985.
4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
