ORDER
(Order of the Court was made by S.M.Subramaniam J.) Learned Special Government Pleader relying on Paragraph No.7 of the compliance report filed by the Assistant Engineer, Public Works Department, Water Resources Organisation, Pethanayakanpalayam would submit that the encroachments have been removed.
2. Paragraph 7 of the report reads as follows, "...
7. It is humbly submitted that after the model code of conduct, the 4th Respondent on 10.06.2024 sought 1st Respondent to survey the subject land and to issue Form- I. We have received Form-1 notices from the 1st Respondent after survey on 24.08.2024, from the concerned Revenue Department. 1st Respondent herein, containing the names and details of the encrochers. In continuation, notices as prescribed in Form II and Form III of Tamil Nadu protection of Tanks and Eviction of Encrochment Act 2007, were served to the respective encroachers in survey no. 483 & 111 of Edayapatty village and
Panaimadal village respectively on 28.08.2024 and 21 days time is given to encroachers to remove the encroachments from the government land which falls on 18.09.2024. Then, the encroachment eviction work is started on 19.09.2024 and all encroached portion as prescribed in Form - 1 notice is completely evicted by Water Resources Department along with Revenue Department and Police Department on 20.09.2024."
3. Learned counsel for the petitioner would submit that some portions of the encroachments are yet to be removed.

If so, the authority shall ensure that all such encroachments are removed without causing any undue delay. It is made clear that, if the left-out encroachments are not removed by the authority, then the petitioner is at liberty to reopen the contempt petition by filing an appropriate petition. Accordingly, the contempt petition is closed. No costs.
