This Civil Miscellaneous Petition has been filed to condone the delay of 314 days in filing the restoration petition to restore the second appeal which was dismissed for default on 05.07.2018.

2. Learned counsel for the respondent has also not raised any serious objection for allowing this petition.

3. This Court is also satisfied with the reasons stated in the affidavit filed in support of this petition. Accordingly, CMP.No.15844 of 2019 is allowed as prayed for.

4. Registry is directed to number the restoration petition and list the same for hearing on 14.06.2021.
