Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd and 3rd Respondents to consider and dispose of the petitioners application and to effectively implement the survey findings in respect of the property comprised in survey no 608/6C situated at Mudhanai Village,Vridhachalam Taluk, by duly demarcating the boundaries and consequently direct the 4the Respondent to provide adequate police protection to the petitioner and the Revenue Authorities for restoring the boundary stones and enabling the petitioner to put up fencing around his property, based on the complaint dated 08.02.2026 and CSR No 0108 / 2026 For Petitioner(s):

ORDER
This writ petition has been filed to direct the respondents to consider the petitioner's representation dated 08.02.2026.
2. Ms.Inthu Karunakaran, learned Government's counsel, takes notice on behalf of the respondents.
3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself.
4. The learned counsel for the petitioner would submit that in this case, though the survey was conducted at the subject land by the officials, no demarcation was done due to the objection raised by the 5th & 6th respondents. Hence, this petition was filed for a direction to the official respondents to lay boundary stones at the subject property, so as to enable the petitioner to put up fencing therein.

On the other hand, the learned Government's counsel appearing for the respondent would submit that in this case, the survey number mentioned in the petitioner's representation is not available and hence, he requests this Court to issue a direction to the petitioner to file a fresh representation before the respondents.
6. In reply, the learned counsel for the petitioner would submit that the petitioner had already filed a fresh representation on 04.03.2026 for survey and
demarcation of the subject properties. Hence, he requests this Court to pass appropriate orders.
7. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.
8. In the case on hand, a representation was filed by the petitioner, requesting the respondents to survey the subject land and lay boundary stones therein. However, according to the respondent, the survey number mentioned in the petitioner's representation is not available. Now, it was submitted by the petitioner that a fresh representation dated 04.03.2026 was already filed by the petitioner by mentioning correct survey number.

In view of the above, this Court directs the respondents to consider the petitioner's representation dated 04.03.2026 and after issuing notice to all the concerned parties, dispose of the same, on merits and in accordance with law, within a period of 8 weeks from the date of receipt of a copy of this order.
10. If any police protection is required, the 2nd and 3rd respondents are at liberty to approach the 4th respondent. In such case, the 4th respondent shall provide all necessary protection till the completion of survey by the 2nd & 3rd respondent at the subject land.
11. As far as fencing is concerned, it is the job of the petitioner and no officials can be involved since there is an objection on the part of the adjacent land owners. If there is a dispute over the subject land or a portion thereof, the same has to be decided only by way of filing a suit before the Civil Court.
