For Petitioners in both petitions : Ms.D.Nagasaila For Respondent in both petitions : Mr.A.R.Nixon Government Pleader C OM M O N O R D E R These Contempt Petitions have been filed to punish the respondents for their wilful disobedience of the order passed by this Court in W.P.Nos.23081 and 23093 of 2019 dated 26.11.2020. 2.
The learned counsel appearing for the petitioners submitted that this Court on an earlier occasion issued direction to the respondent to consider the petitioners' claim to pay salary on par with the Drivers. After issuance of the said direction, though the respondent contemnor paid one month salary to the petitioners on par with Drivers. thereafter, they refused to pay and subsequently, vide communication dated 04.10.2021, had rejected the claim of the petitioners and the said communication was
challenged and is pending before the competent Labour Court. Further, the salary paid on par with Drivers is now sought to be recovered by the respondents in view of the rejection of the representation of the petitioners, vide communication dated 05.10.2021. Hence this Court may pass appropriate orders in that regard.
3. The contemnor appeared before this Court and assisted the learned Government counsel, who fairly conceded that the issue is pending before the competent Court and till such time, the issue is decided, the respondent contemnor will not recover any amount from the petitioners.
4. Recording the submission made by the learned Government Pleader, this Contempt Petition is closed.
