Mr.S.Sugendran, Additional Public Prosecutor, takes notice for the respondent.

2. The petitioner is accused in S.C.No.11 of 2018 on the file of the Sessions Judge, FTC Mahila Court, Krishnagiri. The Criminal Miscellaneous Petition has been filed seeking to condone the delay of 399 days in filing the appeal which has been preferred challenging the order of conviction for the offences under Sections 376, 417 and 105(2) of IPC.

3. The learned counsel for the petitioner submitted that since the petitioner is in judicial custody, he is unable to mobilise fund and approach Advocate for filing the appeal.

4. The reasons stated in the accompanying affidavit filed in support of the petition, are satisfied. Hence, this Court is inclined to condone the delay. Accordingly, the condone delay petition is ordered.
