This writ petition is filed under Article 226 of the Constitution of India, seeking writ of mandamus directing the first respondent to consider the petitioner's representation dated 08.04.2026 requesting to count 50 percent of the service rendered by him in the post of Noon Meal organiser from 01.04.1983 to 31.12.1997 and Technical Assistant (NMR daily wages) from 02.01.1998 to 22.10.2008 along with the regular service as Work Inspector and Overseer from 23.10.2008 to 30.06.2016 and grant him pension by considering his case under the Old Pension Scheme and grant all consequential benefit to the petitioner.

Order This writ petition is filed for the following relief: "To direct the first respondent to consider the petitioner's representation dated 08.04.2026 requesting to count 50 percent of the service rendered by him in the post of Noon Meal organiser from 01.04.1983 to 31.12.1997 and Technical Assistant (NMR daily wages) from 02.01.1998 to 22.10.2008 along with the regular service as Work Inspector and Overseer from 23.10.2008 to 30.06.2016 and grant him pension by considering his case under the Old Pension Scheme and grant all consequential benefit to the petitioner."
2. The Petitioner was appointed as Noon Meal Organiser at Bharathi Aided Primary School, Kollanthidal, Therku Poigainallur, Nagapattinam on 01.04.1983.
Subsequently, the Government declared that Noon Meal Organisers are permanent employees of local bodies and granted Special Time Scale of Pay and further granted other benefits as given to regular Government servants. Thereafter, the petitioner was appointed as Technical Assistant and he joined the duty on 02.01.1998 at Thalaignayiru Town Panchayat.
3.The petitioner was promoted as Overseer on 04.03.2016 and retired from service on 30.06.2016. The petitioner would submit that he had made a representation dated 08.04.2026 requesting the respondents to count 50% of the service rendered by him in the post of Noon Meal Organiser from 01.04.1983 to 31.12.1997 and Technical Assistant from 02.01.1998 to 22.10.2008 along with regular service as Work Inspector and Overseer from 23.10.2008 to 30.06.2016 and grant him pension by considering the Old Pension Scheme. Since there was no response, the petitioner is before this Court.

Considering the facts and circumstances of the case and the fact that the petitioner's representation dated 08.04.2026 has not been considered to date, a direction is issued to respondents to consider the petitioner's representation and pass orders on merits and in accordance with law, within a period of 6 weeks from the date of receipt of a copy of this order.
