O R D E R

The petitioner, who was arrested and remanded to judicial custody on 29.04.2025, for the offences punishable under Sections 316(2), 318(4), 296(b), 351(2) of the Bharatiya Nyaya Sanhita 2003, in connection with Crime No.151 of 1/4

2025, registered on the file of the respondent, seeks bail.

The case of the prosecution is that the de-facto complainant is running a hotel and the accused persons A1/Imran and his wife A2 are running an unauthorised Chit, in which the de-facto complainant has paid a two chit amount worth Rs.5 lakhs and Rs.7 lakhs amounting to Rs.6,71,250/-. Later, the de-facto complainant came to know that the accused persons cheated him and when the de-facto complainant asked the accused to return the money, the accused persons denied to repay the amount and abused the complainant in filthy language and also cheated him. Hence the complaint.

3. It is the contention of the petitioner that now day by day, the exaggerated complaints have been received from various persons and now the cheated amount increased manifold. In this case, A2 has been granted bail by this Court vide order dated 21.05.2025 made in Crl.O.P No.14359 of 2025. The learned counsel further submitted that the petitioner is suffering incarceration from 29.04.2025 and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner. 2/4

Learned Government Advocate (Criminal Side) appearing for the respondent police filed a counter affidavit stating hat A2 is none other than the wife of A1 and she being a lady, anticipatory bail was granted by this Court on 21.05.2025. During investigation, it revealed that till now, there are 23 victims and the total amount is approximately 66,00,970/-. Further, he submitted that investigation is in progress and the respondent have collected the documents and bank details and the statement of the victims have been recorded. Now, the case in Crime No.151 of 2025 was transferred from C-2 Sungavarchatram Police, Station, Kancheepuram to District Crime Branch, Kancheepuram on 09.06.2025. Hence, he strongly opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case, nature of offence committed by the petitioner and huge amount is involved in this case, this Court is not inclined to grant bail to the petitioner.
