ORDER

This writ miscellaneous petition has been filed by the petitioner seeking restoration of W.P.No.28718 of 2022, which was dismissed for non-prosecution by this Court on 29.04.2026.

2. The petition in W.P.No.28718 of 2022 was filed to call for the records of impugned order dated 29.06.2022 in Na.Ka.No.AA1/1280/2021 passed by the second respondent and quash the same as illegal, ultra-virus of the constitution and consequently direct the respondents 1 and 2 to issue patta in respect of S.No.134 of Karivedu Village, Ranipet District measuring about 5 Acres out of the total extent of 9.86 Acres.

3. On 27.04.2026, when the above writ petition came up for hearing, there was no representation for the petitioner. Hence, the matter was directed to be listed under the caption "for dismissal" on 29.04.2026. Accordingly, the matter was posted under the caption "for dismissal" on 29.04.2026. Notwithstanding the fact that the matter was listed for dismissal, the learned counsel for the petitioner failed to appear before this Court. Hence, on that ground, this Court dismissed the writ petition for non-prosecution.

4. Aggrieved over the same, the present miscellaneous petition has been filed seeking the relief stated in the opening paragraph.

5. Heard the learned counsel for the petitioner and perused the materials available on record.

6. Today, when the matter was taken up for hearing, Mr.T.N.Muralimoghan, the learned counsel for the petitioner submitted that he has undergone piles operation and expressed his remorse for the inconvenience caused to this Court on the previous hearing. Hence, the order dated 29.04.2026, dismissing the case for non-prosecution may be set aside and the writ petition restored to file.

7. Satisfied with the above submissions made by the learned counsel for the petitioner and also considering the fact that the petitioner has underwent surgery, this writ miscellaneous petition stands ordered and the order dated 29.04.2026 dismissing the writ petition for non-prosecution is set aside and the writ petition in W.P.No.28718 of 2022 is restored to file.

8. List the writ petition in W.P.No.28718 of 2022 for hearing on 20.07.2026.
