Appeal under Clause 15 of the Letters Patent against the Order, dated 02.07.2019, passed in W.P.No.15556 of 2019 on the file of this Court.
WP.No.15556 of 2019 : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus Calling for the records of the 1st Respondent relating to Letter Lr. No. 282/CAI/AU/CR_F/2019 dated 11.05.2019 in so far as it reduced the intake by 50 per cent with reference to Under Graduate Courses and Nil intake with reference to Post Graduate Courses and the order of the 3rd Respondent in Letter Lr. No. 298/CAI/AU/2019 dated 21.05.2019 and quash the same and consequently direct the Respondents 1 to 3 to grant affiliation for the full intake of 60 seats in B.E. Civil Engineering 60 seats in B.E. Computer Science Engineering 30 sets in B.E. Electrical and Electronics Engineering 60 seats in B.E. Electronics Communication
Engineering 90 seats in B.E. Mechanical Engineering 60 seats in M.B.A. Master of Business Administration, 18 Seats in M.E. Power Systems Engineering of Surya Engineering College, Perundurai Road, Mettukadai, Kathirampatti Post, Erode - 638 107 for the year 2019-2010 in the light of the order of the Hon'ble Division Bench in WA.No.909 of 2017 dated 16.08.2017. JUDGMENT
(By Dr.Vineet Kothari,J.) Learned counsel for the Respondent-Anna University has produced a Communication of the University following this Court's order, dated 12.07.2019, passed in the present case, and upon re-inspection, finding the deficiencies removed by the Appellant-Institution, namely M/s.Surya Engineering College. By the said Communication, the Respondent-Anna University has permitted the intake of the students for Seven Courses for the year 2019-2020 as prayed for by the Appellant-Institution, and for the Course of B.E. (Electrical and Electronics Engineering) as against 30 seats, the Respondent-University has granted only 23 seats.
2. Copy of the said Communication is placed on record and a copy thereof has been supplied to the learned counsel for the Appellant-Institution also.
3. In view of the said relief having been granted to the Appellant-Institution at the hands of the Respondent-Anna University, Mr.Kandhan Duraisami, learned counsel for the Appellant-Institution, does not want to press this Writ Appeal and he seeks leave of the Court to withdraw the same.
4. Permission is granted and this Writ Appeal is dismissed, as withdrawn. No costs. Consequently, the connected C.M.P.Nos.14495 and 14498 of 2019 are closed. Sd/- Assistant Registrar //True Copy// Sub Assistant Registrar
