in C.P.No.57 of 1998 M.SUNDAR, J Mr.T.Mohan, learned counsel appearing on behalf of/assisted by counsel on record Mr.Abhinav Parthasarathy and Ms.S.V.Supraja and Mr.V.Karthikeyan on behalf of counsel on record for first respondent Mr.R.Karunagaran and Mr.Karthik Seshadri, learned counsel on behalf of 'Official Liquidator attached to this Court' ['OL' for brevity], who is respondent no.2 in both captioned applications are before me.

2. Counsel on record for applicant has made an endorsement that respondents 3 to 6 are given up in these applications as no prayer has been sought for against them. To be noted, these applications are with limited prayers for impleading the applicants.

3. With the consent of all the aforementioned three counsel, the following order is passed:

a) the two applicants in the two applications shall be heard as intervenors in Company Application Nos.159 of 2020 in Company Application No. 174 of 2019 in CP.No.57 of 1998. 1/3

b) Registry shall show the name of the counsel on record for intervenors from the next listing.

c) Captioned applications have been met with a common counter affidavit filed by first respondent and all averments/allegations therein are left open and this Court does not express any view on the same for now.

d) If the counsel on record for intervenors files a search memo, the same shall be entertained by the Registry.

4. In the light of the trajectory this matter has taken today, all averments and allegations in the counter affidavit are left open (as mentioned supra), in other words, this Court does not express any opinion on the same at this juncture, leaving open the rights and contentions to the parties to be canvassed at an appropriate stage of the matter.

5. Captioned applications disposed on on above terms. There shall be no order as to costs.
