ORDER

This Application has been filed to direct the Official Liquidator, the respondent herein to execute the sale deed in respect of 51 cents of land in lot No.1 and Plot No.45 measuring an extent of 8600 sq.ft. and Plot No.198 measuring an extent of 6140 sq.ft in lot 3 at Anubhav Green Rich Village Which were auctioned on 21.03.2013 in favour of company M/s. East West Ethicals Private Limited (PAN No.AAFCE8993E), which is registered under Companies Act 2013, also having its registered office at No.8, Subramaniyapuram, Salem636007 within the time fixed by this Court. 2.The contention of the learned counsel for the Applicant is that the applicant is the successful bidder in the auction held on 21.03.2013 in respect of 51 cents of land in lot no.1 and Plot No.45 measuring to an extent of 8600 Sq.ft. and Plot No.

198 measuring an extent of 6140 Sq.Ft in lot 3 for a total sum of Rs.1,96,49,650/- (Rupees One Crore Ninety Six Lakhs Forty Nine thousand Six Hundred and Fifty only) in respect of the Company in Liquidation, which was confirmed by this Court on 21.03.

the balance sum of Rs.1,76,49,650/-(Rupees One Crore Seventy Six Lakhs Forty Nine Thousand Six Hundred and Fifty only), to be paid on or before 29.04.2013 after adjusting the EMD of Rs.20,00,000/- (Rupees Twenty Lakhs). 3.In response to the said claim, the Official Liquidator submits that if the applicant produces the Encumbrance Certificate to the Official Liquidator from the date of the sale, after verifying the same the Official Liquidator shall execute the sale deed within a period of three weeks from the submission of the documents required by the Official Liquidator. 4.In view of the submissions made by the Official Liquidator, the Application is ordered as prayed for.
