The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6(4), 7(1)(a)(ii) of TN Scheduled Commodities (RDCS) Order, 1982 & Essential Commodities Act, 1955 in Crime No.134 of 2025, on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that based on a secret information, the respondent police went to the spot, conducted vehicles inspection and found that 1,200 kgs of rice valued approximately Rs.6,780/- was illegally transported in a TATA Ace vehicles; that upon investigation of the driver of the said vehicle, it is revealed that the petitioner was also involved in the aforesaid offence. Hence, this case. 3.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; and that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and sought for anticipatory bail to the petitioner. 2/4

Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and on instruction submitted that the petitioner is the owner of the vehicle, who has been arrayed as A2 in this case; that he along with other accused involved in illegal transportation of 1,200 kilograms of rice, which were collected from the local people; that the petitioner has got eight previous cases of similar nature; and that the investigation is pending and opposed the grant of anticipatory bail to the petitioner.

Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.

Taking into consideration the facts and circumstances of the case, the nature of allegation against the petitioner, the submissions made by the learned counsels on either side, the fact that the petitioner has bad antecedents of similar nature and the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
