ORDER

The petitioner, who apprehends arrest at the hands of the respondent police, for the offences punishable under Sections 4(1)(A) and 4(1)(i) of the Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No.83 of 2025, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that A1 and A2 were found to be in illegal possession of 94 bottles (each 180 ml) of Indian Made Foreign Liquor to be supplied to the petitioner. Hence, the case.

3. The contention of the learned counsel for petitioner is that the petitioner is an innocent person and she has been falsely implicated in this case. He further submitted that co-accused/A2 has been arrested and released on bail. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. 2/4

4.The learned Government Advocate strongly opposed for granting anticipatory bail to the petitioner stating that the petitioner alone instructed to purchase and sell the IMFL in black market. In this case, the co-accused/A2 has been arrested and released on bail. He further submitted that the petitioner has got 14 previous cases and the last case was registered in the year 2024.

5.Considering the submissions made and on perusal of the material it is seen that the petitioner through A1 and A2 was selling IMFL bottles for higher rate without any license. The co-accused/A2 was arrested and let out on bail and the petitioner has got 14 previous cases. In this case, 94 bottles (each 180 ml) IMFL have been seized. In view of the same, this Court is not inclined to entertain this anticipatory bail petition and the same is dismissed. 30.06.2025 rsi 3/4
