ORDER
The petitioner, who apprehends arrest for the alleged offences punishable 1/4
under Sections 8(c), 20(b)(ii)(B), 29(1) of Narcotic Drugs & Psychotropic Substances Act, 1985, in Crime No.165 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The case of prosecution is that on 02.03.2025 the petitioner and other accused seized 2.2 kgs of Ganja. Hence this case.
3. The learned counsel appearing for petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.
4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioner along with other accused seized 2.2 kgs of Ganja and eight previous cases are pending against the petitioner. He would also submit that if he is released on anticipatory bail, he would hamper the investigation and tamper the witnesses. However, he would vehemently opposed to grant anticipatory bail to the petitioner.
5. Considering the facts and circumstances, the investigation is not yet completed and if he is released on anticipatory bail and eight previous cases are pending against the petitioner, there is possibility of involving similar offence, hence, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 2/4
