ORDER
By this application, the applicant seeks a direction to the Official Liquidator for the execution of a sale deed/sale certificate in favour of a nominee of the applicant conveying Flat No.102 with the built up area of 758 sq.ft. along with corresponding UDS on the first floor of Block No.1, Alsa Townsville, No.170, Arcot Road, Valasaravakkam, Chennai-87.
2. The Official Liquidator has filed a report dated 12.09.2024. In the said report, the Official Liquidator refers to the earlier application of the applicant in Comp.A.No.360 of 2017 and the order dated 07.07.2017 directing the applicant to pay the balance sale consideration of Rs.95,485/- with interest at the rate of 12% per annum from the date of liquidation till the date of payment. The further direction to pay a sum of Rs.22,700/- with interest at the rate of 24% per annum from 15.03.1996 till the date of payment towards contingency charges is also referred to therein. After pointing 2/4
out that the applicant failed to pay the said amount within the time specified in the order, the Official Liquidator acknowledges that a sum of Rs.5,41,300/- was received on 19.12.2023 and that with this payment, there are no dues from the applicant.
3. In view of the above report, this application is liable to be and is hereby allowed as prayed for. The Official Liquidator shall execute the sale deed/sale certificate in favour of a nominee of the applicant conveying Flat No.102 with the built up area of 758 sq.ft. along with corresponding UDS on the first floor of Block No.1, Alsa Townsville, No.170, Arcot Road, Valasaravakkam, Chennai-87, within three months from the date of receipt of a copy of this order. There shall be no order as to costs.
