PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of mandamus, directing the third respondent to consider the petitioner's representation dated 17.05.2025 and consequently direct the third respondent to register the pending settlement deed in Document (P) No.50 of 2025 dated 23.04.2025 and pass orders.

ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of mandamus to direct the third respondent to consider the petitioner's representation dated 17.05.2025 and consequently direct the third respondent to register the pending settlement deed in Document (P) No.50 of 2025 dated 23.04.2025.

It is submitted by the learned counsel for the petitioner that petitioner executed a settlement deed in favour of his daughter on 23.04.2025 and thereafter, both settlor and settlee presented the same for registration before respondent No.3 on 23.04.2025. Subsequently, the Settlement deed was assigned with pending Document No.50 of 2025. The third respondent intimated the petitioner by pending slip dated 25.04.2025 that the settlement deed document is pending for scrutiny and the same would be released after verification. Since the settlement deed document was not registered even after a lapse of one month, the petitioner submitted a representation dated 17.05.2025 before the third respondent to register the 2/6

settlement deed document in P.50 of 2025. However, the said representation has not been considered so far. Aggrieved by the same, the petitioner has come before this Court.

At the outset, it was submitted by the learned Special Government Pleader for respondents that the representation 17.05.2025 would be examined and the pending settlement deed in Document No.50 of 2025 dated 23.04.2025 would be registered, if it is otherwise in order, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner. In case of refusal, it is also submitted that the respondent authority while refusing, would pass an order containing reasons.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the third respondent, to examine the representation dated 17.05.2025 and register the pending settlement deed in Document No.50 of 2025 dated 23.04.2025, if it is otherwise in order, on its own merits and in accordance with law, within a period of two (2) weeks from the date of receipt of a copy of this order. If for any reason, the third respondent refuses to register the settlement deed, 3/6

he shall assign reasons in the refusal slip, which was agreed to by both counsel for petitioner as well as respondent. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.
