ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence punishable under Sections 448 and 506(ii) I.P.C of I.P.C, in Crime No.421 of 2020 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner was implicated earlier in Crime No.88 of 2020. This Court granted anticipatory bail to the petitioner in Crl.O.P.No.17863 of 2021 imposed a condition that the petitioner shall not tamper with the evidence or witness during investigation or trial. Subsequently, the petitioner along with others tried to assault the defacto complainant and thereby threatened him. Hence the Law Enforcing Agency registered a case against the petitioner.
3.The learned counsel appearing for the petitioner submits that the petitioner has not committed any such offence as alleged by the prosecution and she has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) submits that in an earlier occasion this Court granted anticipatory bail to the petitioner in Crl.O.P.No.17863 of 2021 dated 27.09.2021 by imposing a https://hcservices.ecourts.gov.in/hcservices/
condition that the petitioner shall not tamper with the evidence or witness during investigation or trial. However, the petitioner along with others tried to assault the defacto complainant and thereby threatened him. Therefore in violation of the condition of bail, he vehemently opposed for grant of anticipatory bail to the petitioner.
5. In view of the fact that the petitioner has violated the conditions imposed by this court in Crl.O.P.No.17863 of 2021 and has assaulted the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this petition is dismissed.
