Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to allow the petitioner herein to intervene in the above WP.No.10666 of 2019(in WMP.No.21719/2019 in WP.No.10666/2019) Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.ELANGOO, Advocate for the petitioner and of M/S.J.RAVINDRAN Additional Advocate General assisted by MRS.R.ANITHA Advocate for 2 to 7 respondents and MR.SIVAKUMAR Advocate for 1st respondent the court made the following order:- (Order of the Court was made by the Hon'ble Acting Chief Justice) Heard on the application seeking to permit the petitioner to intervene in the writ petition.
2. The applicant is a practising advocate. He submits that the building of the government school was constructed with the contribution made by the Lions Club and from the funds of the government under the scheme "Namakku Namay Thitam". The public has also contributed for the construction of the building. The applicant seeks to intervene in this matter, as he was a member of the Lions Club, rather shouldered the responsibility of the post of President at some point of time.
3. We have considered the submission made by learned counsel for the applicant and find no material to establish the locus of the applicant to permit him to intervene. It is not disputed that the school is a government school. The government is a party respondent and it can justify the establishment of the government school with records, if required. Moreover, the prayer in the writ petition is to remove the encroachments on waterbody. In view of the above, we do not find any reason to permit the applicant to intervene in the writ petition. Accordingly, W.M.P.No.21719 of 2021 is dismissed.
