ORDER

The present wit petition has been filed with a prayer for Mandamus to direct the respondent to settle the amount which has been deducted by them at Rs.5/- by way of monthly deduction.

2.The learned counsel appearing on behalf of the petitioner would submit that only after filing another writ petition in W.P.No.24675 of 2013, the respondent has settled a sum of Rs.2,87,972/- whereas the total amount which he is entitled to be received on account of reduction of Rs.5/- per month was not settled to the petitioner. In this connection, the petitioner has sent a representation to the respondent on 20.09.2024 and such representation is yet to be considered by the respondent.

3.Per contra, the learned Standing Counsel appearing on behalf of the respondent would vehemently contend that the petitioner was removed from service during July 1997 and he has preferred a Writ Petition only during 2015 for recovery of certain amounts and on filing a writ petition, the respondent has already been settled his eligible amount and that now there are no amount due to be paid to the petitioner.

4.I have given my anxious consideration on either side submission. 5.On the facts of the case, the petitioner was removed from service during 1997 and it seems that he has already filed another writ petition 2/4

claiming certain amounts wherein this monthly deduction amount was not included and there is a long delay of more than 18 years in claiming this amount. Hence, this Court does not find any merits in the present writ petition on account of delay and latches and the same is liable to be dismissed. 6.In the result, the Writ Petition is dismissed.
