This petition has been filed seeking to condone the delay of 167 days in preferring the Civil Miscellaneous Appeal.
2. Ms.A.Saloni, learned counsel, takes notice for the 2nd respondent.
3. The learned counsel for the petitioner submitted that the 1st respondent was set ex parte before the Tribunal and the 2nd respondent is the contesting party. He further submitted that the appeal has been filed only for enhancement of the compensation.
4. The reasons adduced in the affidavit filed in support of this petition being satisfactory, this Civil Miscellaneous Petition is ordered and consequently, the delay of 167 days in preferring the appeal is condoned.
5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order, and list the same for admission next week.
